Rental Agreement for The Whimsical Wave - Whole House:
Property Location - 1101 Baltimore Avenue, Ocean City, MD 21842 (Ground Level)

Please keep this in mind during your stay:
This agreement, dated (per the date of accepted booking on the marketing platform/website), is between the “Owner/Agents” of the property and the “Renter/Occupants” {aka: Guest or Guests} booking their stay at Lakewood Lodge. This agreement is legally binding upon acceptance of the “Renter/Occupants.”
RESERVATION PERIOD: Agreed upon at the booking of the property on the chosen marketing platform/ website.
CHECK-IN: Upon your day of check in, you may arrive at 4:00 pm or later. No early check-ins are permitted, unless otherwise agreed upon by both parties prior to the check-in period. In many instances, this will not be an option (especially during peak or holiday seasons).
CHECK OUT: On your day of check out, if you wish, you may check out earlier, but you must be out of the premises by 10:00 am. No exceptions, as this is part of the contract we have with our cleaning team. If you believe you will need extra time on your check out day, contact the owner/agents to see if something can be worked out.
MAXIMUM OCCUPANCY: The maximum number of guests per home is limited to twenty (20) persons. An additional charge may be applied, per person, per night, for guests in addition to twenty(20) could be assessed. Please get pre-approval from owners if more than twenty (20) guests will be staying in the home at any given point during your reservation.
This property requires anywhere from a TWO (2) night minimum stay and a SEVEN (7) night minimum {ex: Friday to Friday} during peak and holiday seasons unless pre-arranged.
CHILDREN: All children must be under adult supervision at all times to ensure their safety and proper use of items within the home.
NOTICE: The provided bunk beds (not limited to, but usually utilized by younger ages) do present an inherent possibility for injury. The Renter/Occupants agree that they have been given notification and agree they will hold the Owner/Agents harmless of any and all liabilities, resulting from the use of the bunk beds.
RATES: Rates subject to change without notice until a deposit is received. Rates are based on several factors to include, but not limited to: date range of stay, length of stay, additional fees incurred prior to and during stay, etc…
DAMAGE AND INCIDENTS: You will be responsible for any damage to the rental property caused by you or your party during the stay.
ACCIDENTAL DAMAGE PROTECTION/ DAMAGE DEPOSIT: This is required and based upon the platform utilized for your booking. The coverage is NOT applied toward rent. It is fully refundable within (14) days of departure {marketing platforms/ websites may have different timelines}.
Damage protection and damage deposits are intended to pay any costs of damages, replacement, cleaning, trash removal, excessive wear and tear in addition to moving furniture back to its original place, repairs due to abuse and/or negligence by Renter, Renter’s guests, occupants and/or invitees.
Renter/Occupants may be responsible for any unpaid charges, court and/or attorney fees suffered by the Owner/Agents by reason of Guests default of this Agreement and in accordance with state and local laws and regulations.
The premises must be left in good, clean condition with all trash, debris, and Renters/Occupants personal property removed at time of departure, and with all appliances and equipment in clean working order.
Owner/Agents recovery for damages will not be limited to the amount of the Accidental Damage Protection/Damage Deposit.
APPLIANCES: Owner/Agents will supply Refrigerator, Stove/Oven, Dishwasher, Microwave, Washer/Dryer.
Renter/Occupants will keep appliances provided by Owner/Agents in good working order and shall immediately report any malfunction to the Owner/Agents. Any damage sustained due to the neglect or misuse by the Renter/Occupants, will become the full responsibility of the Renter/Occupants, either in the appliance repair or replacement.
Renter/Occupants agree that the items specified above are the property of the Owner/Agents and will remain with the premises at the end of the reservation period.
MAINTENANCE AND REPAIRS: If a property maintenance need occurs during your stay –
It is the responsibility of the Renter/Occupants to promptly notify the Owner/Agents of the need for any such repair which the Renter becomes aware of.
If any repair is required and is caused by the negligence of the Renter/Occupants, Renter/Occupants will have full responsibility for the cost of the repair and/or replacement that may be required.
Renter/Occupants must keep the premises clean and sanitary at all times. Remove all rubbish, garbage, and other waste, in a clean, tidy, and sanitary manner.
Renter/Occupants must abide by all local recycling regulations.
Renter/Occupants shall properly use and operate all electrical, cooking, and plumbing fixtures. Also, keeping them clean and sanitary.
Renter/Occupants agree to take proper measures to maintain proper indoor temperature, in order to prevent pipes from freezing and/or the overworking of the HVAC heating/cooling system(s), as applicable. When opening windows, verify the HVAC system has been turned off.
FURNISHINGS: Any and all furnishings provided, are the property of the Owner/Agents. Renter/Occupants are expected to exercise care in the use of all items, including ensuring that no wet clothing, shoes, boots, bathing suits, are placed on flooring or furniture. Renter/Occupants are to make sure sand/dirt is cleaned up immediately. All appliances are to be used with care. Nothing is to be relocated without the permission of the Owner/Agents.
RENTER/OCCUPANTS RESPONSIBILITY: Renter/Occupants must follow the terms and conditions contained within this Vacation Rental agreement. Any violation of the rules, regulations, terms and/or conditions, shall be cause for the immediate termination of this agreement as well as expedited eviction without refund as permitted by law.
HOLD HARMLESS: Owner/Agents do not accept any liability for loss, damage, or injury, to persons or their personal property due to forces that are beyond the Owner/Agents control; such as, but not limited to: poor weather, bad road conditions, natural disasters, power outages, mandatory evacuations, construction, and/or “Acts of God.” Owner/Agents are not responsible for any inconveniences that may occur to prevent the use of amenities; such as, but not limited to: pools, hot tubs, television, and internet. REFUNDS WILL NOT BE GIVEN DUE TO POOR WEATHER CONDITIONS OR OTHER OCCURRENCES SUCH AS THOSE LISTED HEREIN.
PETS ARE NOT ALLOWED: Due to insurance regulations, pets of any kind are not allowed within/ on the premises. Per this agreement with the Owner/Agents, no pets are allowed, with the exception of service animals according to Federal, State, and Local Regulations. Please advise the Owner/Agents of a service animal and include the proper/ official documentation for the animal.
RULES AND REGULATIONS: The Renter/Occupants are responsible for and must make sure that all rules are followed.
The minimum age of the primary renter is twenty-five (25) years of age and confirms they will be staying on site for the duration of the booking. No group rentals permitted, by anyone, under the age of twenty-five (25).
Vehicles must be parked on the street in legal parking areas. The Owner/Agents are held harmless in the event of ticketing, vandalism, theft, or any other occurrences during the Renter/Occupants stay. NO LARGE/RECREATIONAL VEHICLES OR WATERCRAFT OF ANY KIND ARE ALLOWED TO BE PARKED IN DRIVEWAY OR IN FRONT OF THE HOME. There is street parking, free and paid, in the area. Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines and/or towing fees are the sole responsibility of the vehicle owner and could also result in forfeit of security deposit if any damage to this property or other properties occurs.
ABSOLUTELY no smoking or vaping, of any kind, inside of the premises (Outside smoking is permitted. PLEASE be courteous of current and future guests by safely disposing of cigarette butts and spent vape cartridges).
The Renter/Occupants may not interfere with the peaceful enjoyment of the neighbors.
Garbage and trash must be deposited in the provided receptacles. The possibility of a wild animal getting into the trash is possible. Please make sure all trash is bagged and disposed of properly.
The Renter/Occupants are responsible for any fine and/or violation that is imposed on the Owner/Agents due to the negligence of the Renter/Occupants.
The Renter/Occupants shall abide by all Federal, State, and Local laws.
The Renter/Occupants shall notify the police and the Owner/Agents of any illegal activity that is witnessed in or around the Vacation Rental premises.
The Renter/Occupants agree not to use the Vacation Rental premises for any unlawful purpose including, but not limited to the sale, use, or possession of illegal drugs on or around the Vacation Rental premises.
The Renter/Occupants must report any malfunction with smoke/ carbon monoxide detectors immediately to the owner. The Renter/Occupants agree not to remove, dismantle, or take any action to interfere with the operation of any smoke detectors installed within the Vacation Rental premises.
Absolutely no hazardous materials are permitted to be in or around the Vacation Rental premises at any time.
The Renter/Occupants may not use or store kerosene or space heaters at any time in or around the Vacation Rental premises.
Under no circumstance may a stove or oven be used as a source for heat.
Charcoal and gas grills may only be used OUTSIDE of the Vacation Rental and must be away from the home. Never use inside.
The Renter/Occupants agree to keep ALL windows and doors closed during inclement weather. If windows and doors are opened during “good” weather, The Renter/Occupants agree to turn off the Heating/Air Conditioning, so as not to damage the system. The Renter/Occupants agree to turn the HVAC system back on to maintain a comfortable atmosphere within the Vacation Rental.
Owners/Agents do not permit loud gatherings. A disturbance caused by the Renter/Occupants that results in police action or complaints from neighbors, is considered sufficient cause for immediate termination of this Vacation Rental agreement. Immediate eviction and all monies paid will be forfeited as permitted by law.
SECURITY NOT PROMISED: The Renter/Occupants have inspected and acknowledged that all door and window locks, fire extinguishers, security alarm systems (if available), and/or carbon monoxide detectors are in sound working order. The Renter/Occupants further understand and acknowledge that although the Owner/Agents make every effort to make the Vacation Rental premises safe and secure, this in no way creates a promise of security.
RIGHT OF ENTRY: Owner/Agents reserve the right to inspect the Vacation Rental premises with advance notice. In the event of an emergency or to make repairs, the Owner/Agents are permitted to gain entrance to the premises. The Renter/Occupants shall not prevent the Owner/Agents from gaining entrance under these circumstances. Owner/Agents will not infringe upon the peaceful enjoyment of the Renter/Occupants and will exercise a reasonable notice before entering.
CANCELLATION: Cancellation policies are established via the marketing platform/website your reservation has been confirmed through and are subject to the terms and conditions of the marketing platform/website used. Cancellations or changes, that result in a shortened stay, forfeit payment. Cancellation or early departure does not warrant any refund of rent or deposit. We highly recommend you purchase travel insurance separately to cover possible cancellations. A recommendation is listed on our description.
PAYMENT: Payments and damage deposits are collected and returned via the marketing platform/website your reservation has been confirmed through and are subject to the terms and conditions of the marketing platform/website. The advance payment is not a damage deposit. The BALANCE OF RENT is due as expected from the marketing platform/ website used.
CLEANING FEES: Rates include a one-time linen/towel setup. You paid a cleaning fee with your reservation that includes setting up linen-towel service for you as a guest, it does not include any additional clean up or trash removal during your stay.
NO DAILY MAID SERVICE: While linens and bath towels are included in the Vacation Rental premises, daily maid service is not included in the rental rate. However, this accommodation could be made available at an additional rate, when agreed to by the cleaning team and pre-approved with the owner.
Please, do not take any bath towels or linens from the property or use them in any manner other than what they are intended for. We do suggest you bring your own beach towels for use at the pool and for the hot tub (when present on the premises). We do not provide these for our guests. Somehow we do have “strays” left behind periodically. These “strays” may be present, but do tend to make it back home with other guests when they depart, so there is no guarantee.
FALSIFIED RESERVATIONS: Any reservation obtained under false pretense, will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check in.
WRITTEN EXCEPTIONS: Any exceptions to any of the above aforementioned policies, MUST be approved in writing, in advance. Messaging through the platform (preferred) or directly with the owner (a follow up confirmation message will be sent via the platform), is acceptable.
FIREPLACES: If applicable, the fireplace is a non-vented electric log fired firebox. Please do not throw any paper or other combustible materials in the fireplace. Fireplaces are turned off from April 15-September 15; they are not operational during this time of the year.
OPEN FIRES: Open fires are not allowed anywhere on the premises, except when utilizing a propane Fire Pit (when present). Smoking and vaping is only allowed outside (please be respectful to current and future guests by not leaving remains on the ground). There should be a small bucket near the stairs outside on the patio, if needed, for your convenience.
TRAVEL INSURANCE: If you choose to purchase this, you will need to purchase travel insurance separately to cover possible cancellations. Make sure to get a policy that states “coverage/cancellation for any reason.” In light of recent events surrounding Covid-19 and other unforeseen events, We highly recommend this insurance!!
NOISE MONITORING: The home is monitored by Minut, a noise monitoring system. It does not record anything, maintaining your privacy! It only monitors the decibels, which helps keep the neighbors happy too. Minut is more than just noise monitoring. Minut also allows us to monitor indoor temperature, motion, humidity, and is used as an alarm when the property is unoccupied.
I (Renter/ Occupants) agree that all rental monies are non-refundable per cancellation policy above. If booked online through our partner sites, at time of acceptance, you (the Renter/ Occupants) are acknowledging this Rental Agreement.
